General terms

I. Purpose

The parties agree that the rental subject to this agreement is a seasonal rental and cannot under any circumstances be established as the client's primary residence.

II. Description of the Rented Premises

Property Capacity:
The number of persons occupying the property must not exceed the number of sleeping accommodations mentioned. In case the number of occupants planned exceeds the initial request, the TENANT agrees to seek prior approval from the management, which reserves the right to adjust the rental price if necessary. Any additional person not authorized by the Management and staying in the property without prior consent will be charged.

The property is only rented for vacation purposes. Any commercial event or party is strictly prohibited. Any unauthorized use of the property will result in the immediate eviction of its occupants without any possibility of a refund.

Animals are only allowed if their presence has been requested and accepted during the reservation.

III. Duration of the Rental

The stay cannot exceed the number of nights indicated on the attached reservation, except with written consent from the Management. The total rent amount will remain with FARE TIAIA in the event that the TENANT decides to shorten the rental period. At the start of the rental, the Management or its representative will provide the TENANT with the keys and instructions related to the accommodation.

The TENANT cannot, under any circumstances, claim a right to remain in the rented premises upon the expiration of the rental period specified in this contract. In the event of unauthorized extension of the rental duration by more than three hours beyond the check-out date and time mentioned in the reservation, an additional night will be charged to the TENANT.

Entry into the bungalow / check-in is scheduled from 2:00 PM. With prior agreement, we can allow early arrivals / early check-ins between 8:00 AM and 2:00 PM at no additional cost, subject to availability.

All arrivals after 5:00 PM are possible, provided that Fare Tiaia is informed no later than the day before arrival. Clients or the travel agency must contact Fare Tiaia via WhatsApp, email, or phone to confirm the clients' arrival time. Outside regular check-in hours, a night guide service is available for the comfort of tenants. At the appointment for entry into the rental, a representative of FARE TIAIA or one of its agents (or house staff) will be waiting for you on the premises. You will conduct a tour of the property together.

In case of delay, we kindly ask you to inform us so that we can reorganize accordingly. We will provide you with directions or a meeting point.

Delay :
If you are arriving after 5:00 PM, an agent will be there to welcome you. In case of a delay in your arrival, we kindly ask you to inform us as soon as possible. Any delays not communicated to FARE TIAIA, exceeding one hour of waiting, will be charged at 67 € (or 8,000 XPF).

This is why we ask the client and/or agency to confirm the arrival time as soon as possible.
An early check-in is possible if the bungalow is ready beforehand; otherwise, clients can leave their belongings and enjoy the common areas: terrace, kitchen, garden, and beach while waiting for the bungalow to be prepared.

Check-out / departure from the bungalow with key return must be done no later than 10:00 AM. Our representative, at an agreed-upon time (upon your arrival), will meet you on-site around 9:45 AM for an inspection and key retrieval. Late check-out is possible depending on availability and will incur an additional night's charge. Failure to return the keys at check-out/departure may result in legal action and additional fees of 10 000 XPF.

IV. Rent

IV.I Amount and Payment of Rent

The agreed-upon rent is the one mentioned in the attached reservation.
This rent includes:

- Bed and bath linens provided upon arriva
- Normal water, gas, and electricity consumption
- Cleaning of the premises before your arrival and upon departure
- Check-in and check-out
- Assistance during your stay
- Complimentary Internet connection
- Amenities: Kayak, bicycles, paddleboards, lounge chairs
- Fees

If the departure cleaning is included in the rental amount, please note that an additional fee of 10,000 XPF will be charged if we find during the check-out inspection that the condition of the bungalow is deplorable or requires more than reasonable cleaning to restore it to its original state.
The linens are provided upon entry into the premises, and it is the tenant's responsibility to maintain them during their stay. At the end of the stay, the tenant must not take any linens or other items belonging to Fare Tiaia.

Deposit :
A deposit of 50 percent of the total rental amount must be paid upon booking to confirm it. The balance is due before the arrival date and can be paid in various ways:
- By local check payable to FARE TIAIA;
- By bank transfer:

In the case of a bank transfer, the transfer fees and exchange rate fluctuations are the sole responsibility of the tenant. The amount received in XPF or € must match exactly the amount quoted at the time of reservation in XPF.

Balance Payment :
The balance must be paid no later than before the arrival date.
All reservations must be settled before the day of the arrival date.
Upon receipt of payment, an email will confirm your reservation and its details.
No keys will be handed over without the full payment of your stay.

IV.II Security Deposit

The TENANT shall provide FARE TIAIA with a security deposit, by Polynesian bank check or in cash, of 10,000 XPF. This security deposit is due upon entry into the premises and will not be cashed, subject to the condition of the check-out inspection.
The purpose of the security deposit is to cover any necessary repairs or restoration that may be required following the departure of the TENANT, as well as the replacement of missing or damaged items (furniture, linens, etc.). The security deposit should not be considered as a contribution to the rent payment.

If no damage is found during the check-out inspection:
- The security deposit by check or in cash will be returned to the TENANT during check-out.
- The check will not be returned, and if the cost of restoration exceeds the amount of the security deposit by check or in cash, the TENANT agrees to pay the additional amount required by Fare Tiaia, plus 10 percent;

IV.III Linens

Linens are provided upon entry into the premises, and it is the tenant's responsibility to maintain them during their stay. At the end of the stay, the tenant must not take any linens or other items belonging to Fare Tiaia. If one or more items belonging to Fare Tiaia, such as towels, rugs, pillows, duvets, hairdryers, or any other equipment from the common kitchen, go missing or are damaged, the client agrees to pay for the damages related to the disappearance and damage of Fare Tiaia's property.
If, as applicable, any items are missing or damaged, we will cash the security deposit, whether it is in the form of a check or cash.
In addition to the replacement costs of the missing linens, a flat fee of 5,000 FCP will also be charged for the incurred travel expenses associated with repurchasing the missing item.

IV.IV Tourist tax

A tourist tax of 60 XPF per person per night is to be paid to FARE TIAIA on the day of check-in if it has not been collected previously (see details on the invoice).
Fare Tiaia is not responsible for personal items left on the property during or after the stay and shall not be held liable for damages, bodily harm, losses, or expenses directly or indirectly resulting from events beyond our control.

V. Tenant's Obligations

The TENANT undertakes to occupy the property solely for private purposes during their tourist or professional stay. Under no circumstances may it be used for a party or commercial activity. The bungalow must be occupied by the client themselves and their companions within the limit of the number of persons on the reservation.

The TENANT must inform the Management within 24 hours of their arrival if any equipment is not functioning properly or for any dissatisfaction (e.g., cleanliness of the property). Beyond this period, the TENANT accepts the rental as it was entrusted to them. Otherwise, Fare Tiaia will make every effort to intervene as quickly as possible; however, there are few service providers available on our islands, especially on weekends, holidays, and evenings. If a malfunction occurs with fundamental equipment such as plumbing, the electrical system, or appliances, the agency will do its utmost to ensure that repairs are carried out as quickly as possible.

The TENANT shall take the rented premises in their current state and shall maintain them in good condition throughout the entire duration of the stay. They shall be responsible for any damage and losses occurring during the stay in the bungalow, of which they have exclusive use unless they can prove that they occurred before check-in or were due to force majeure, hurricanes, storms, fires.

- Any transformation or modification is prohibited. Furniture must not be moved or rearranged.
- All intentional or unintentional damage caused by the tenant during their stay will be charged to them.

The TENANT shall have no recourse against Fare Tiaia in the event of theft on the rented premises. Fare Tiaia shall not be held responsible for general water, gas, or electricity outages, theft or damage to personal effects, or nuisances caused by neighbors.

The TENANT also undertakes not to cause any disturbances or nuisances to the neighborhood. The sound level of music reproduction devices, radio, and television should be adjusted so that neighbors are not disturbed. In any case, all noise, regardless of its cause, is prohibited from 10:00 PM to 7:00 AM. Do not use any machines or devices that could cause inconvenience to the neighborhood due to bad odors, dirtiness, vibrations, tremors, and noise, or in any other way.

Daily cleaning is not included in the rental rate. Cleaning is done at check-out and every 3 days if the stay is longer than 3 nights. However, the TENANT is obligated to return the property in the same state of cleanliness and order as upon arrival. The bungalow must be returned in the condition in which it was entrusted to the tenant. Otherwise, the security deposit in the form of a check or cash will not be returned to the client.
>The tenant must clean and put away their dishes, dispose of their garbage in the appropriate bins, following the sorting guidelines for gray bin, green bin, and glass bottles.

The TENANT must return the key to one of our agents (or house staff, or at the designated location) during check-out. If the keys are missing at the tenant's departure, the security deposit will not be returned.

VI. Check-in and Inventory

The parties will establish an inventory and condition report at the end of the stay, concerning the state of the bungalow, furniture, and objects made available to the TENANT. The inventory and condition report will be established in the presence of both parties.

VII. Insurance

The TENANT, if they have one, agrees to provide Fare Tiaia with their Civil Liability insurance certificate (covering damage caused by carelessness or negligence) at the time of booking. In the event that the TENANT is not covered by Civil Liability insurance, the Tenant acknowledges and accepts the risks involved.

VIII. Modification - Cancellation of the Rental :

Modifications to Your Reservation:
This refers to modifications made to the arrival or departure dates. A fee of 5500 XPF is charged if the modification request is made 30 days before the scheduled arrival date, subject to a guaranteed date change.

Cancellation (Partial and Complete) :
90 to 61 days before arrival: 30 percent of the total amount.
60 to 31 days before arrival: 60 percent of the total amount.
30 days or less from the day of arrival: 100 percent of the total amount.
No Show and Early Checkout: 100 percent of the total remaining nights.

IX. Termination of the Contract :

This contract will be automatically terminated, and Fare Tiaia may dispose of the leased property:
- In the event that the TENANT does not show up after 5:00 PM on the scheduled day of arrival, and in the absence of a notification of late arrival.
- In the event that the TENANT does not pay the balance of the rent, at the latest, before arrival.

X. Settlement of Disputes :

In the event of a dispute concerning these terms or any dispute arising from their application, only the courts of French Polynesia will have jurisdiction.
